  1. If and when the Florida Department of Transportation approves a new set of plans for the path, the city will need to resubmit the new plans to the DEP for the DEP to consider an Environmental Resource Permit.

  1. The DEP’s jurisdiction over the path is limited to its impact on Wetlands and the Bay’s water quality. Issues of potential erosion, impact on trees & wildlife rest with other agencies, namely the Army Corps of Engineers & the Florida Fish and Wildlife Conservation Commission. The current status of the Army Corps of Engineers' review is that it continues and is not yet completed. No time frame for completion has been given. Coordination for compliance with Section 106 of the National Historic Preservation Act is ongoing. The Army Corps is also waiting to receive verification that water quality certification has been granted by the state.

  1. The State, not the City, owns the West Beach Drive Right of Way. While the city can apply for an Environmental Resource Permit, the permit can only be issued if the State gives the city its permission to build this path on the State’s Right of Way.
